Welcome to Colours Across Art Gallery. These Terms and Conditions govern your use of our website and any purchases made through it. By placing an order, you agree to the terms outlined below.

1. Overview

Colours Across Art Gallery is an online gallery offering a curated selection of pre-loved (second-hand) artworks and original pieces by living artists (“Featured Artists”). Our goal is to provide accurate and transparent descriptions, ensuring a fair and enjoyable experience for all art lovers.

 

2. Acceptance of Terms

By accessing or using our site and services, you confirm:

• You're at least 18 years old (or have parental consent)

• You’ll abide by applicable UK laws

• You’re not using our service for illegal or unfair purposes

We reserve the right to refuse service, suspend accounts, or cancel orders at our discretion.

 

3. Condition of Pre-Loved Artwork

Some items offered through Colours Across Art Gallery are pre-loved artworks, meaning they may have been previously owned and may show signs of age or wear. We take care to:

• Describe each piece honestly and in detail.

• Provide high-resolution photographs, including images of corners, edges, backings, frames, and any visible imperfections.

However, due to the nature of vintage and second-hand items, we cannot guarantee that they are in perfect condition. By purchasing a pre-loved artwork, you acknowledge and accept that minor imperfections may be present.

 

4. Accuracy of Descriptions

We strive to be as accurate and transparent as possible when describing:

• The origin and materials of an artwork

• The name of the artist

• The estimated period of production

• The historical and cultural context

While we often consult museums, experts, and academic sources, we cannot guarantee that all information is completely error-free or definitive, especially when dealing with vintage or undocumented works.

If you believe that an artwork has been materially misrepresented, you are entitled to request a return or refund in accordance with our Return and Refund Policy. Once the time for returns has passed (14 days), we are unable to accept claims related to attribution, age, or condition.

 

5. Delivery of Featured Artists' Work

Artworks by our Featured Artists are sometimes stored off-site by the artists themselves. As a result:

• Shipping times may be longer than for pre-loved pieces already in our possession.

• Colours Across will coordinate collection from the artist once a purchase is made and arrange delivery thereafter.

We will always aim to communicate clearly about estimated timelines and keep you updated throughout the process.

 

6. Order Acceptance & Availability

• Order acceptance occurs when we process payment.

• We may limit or cancel orders at our discretion (e.g., suspected resellers, stock errors, or fraudulent activity).

• In case of cancellation, you’ll be notified and refunded.

 

7. Pricing and Payment

• All prices are in Pound Sterling (£). As we are not VAT-registered, no VAT is added to our prices.

• We reserve the right to adjust prices or availability at any time.

• Payment is accepted via the secure payment methods listed at checkout.

• Full payment must be received before an item is dispatched.

 

8. Ownership and Copyright

• Purchasing an artwork gives you ownership of the physical piece only. It does not transfer any intellectual property rights (such as copyright), unless this is explicitly stated in writing.

• Colours Across does not hold copyright for most artworks sold and therefore cannot grant permission for reproduction, publication, or commercial use.

• You may not reproduce, distribute, or commercially exploit any image of the artwork without written permission from the copyright holder (usually the artist or their estate).

 

9. Returns and Refunds

Please refer to our Return and Refund Policy for full details on how to initiate a return, the time frames involved, and the eligibility conditions. In brief:

• Returns must be requested within the specified period after delivery (14 days).

• After this period has passed, no refunds will be granted.

 

10. Limitation of Liability

While we make every effort to ensure a smooth transaction, we are not liable for:

• Delays due to third-party couriers or unforeseen circumstances.

• Inaccuracies in third-party historical records or artist biographies.

• Minor discrepancies in colour, tone, or texture due to screen differences.

• Indirect or consequential losses (e.g. loss of earnings or missed exhibitions due to delayed delivery).

 

11. Intellectual Property

• All website content (text, images, design) is owned by Colours Across Art Gallery or its licensors.

• You may not use it without our express written permission.

 

12. Amendments

We reserve the right to update these Terms and Conditions at any time. The latest version will always be published on this page. Continued use of the site and/or services constitutes acceptance of the current terms.

 

13. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales, and any disputes will be resolved in the courts of England and Wales.
