Welcome to Colours Across Art Gallery. These Terms and Conditions govern your use of our website and any purchases made through it. By placing an order, you agree to the terms outlined below.

1. Overview

Colours Across Art Gallery is an online gallery offering a curated selection of pre-loved (second-hand) artworks and original pieces by living artists (“Featured Artists”). Our goal is to provide accurate and transparent descriptions, ensuring a fair and enjoyable experience for all art lovers.

 

2. Acceptance of Terms

By accessing or using our site and services, you confirm:

• You're at least 18 years old (or have parental consent)

• You’ll abide by applicable UK laws

• You’re not using our service for illegal or unfair purposes

We reserve the right to refuse service, suspend accounts, or cancel orders at our discretion.

 

3. Condition of Pre-Loved Artwork

Some items offered through Colours Across Art Gallery are pre-loved artworks, meaning they may have been previously owned and may show signs of age or wear. We take care to:

• Describe each piece honestly and in detail.

• Provide high-resolution photographs, including images of corners, edges, backings, frames, and any visible imperfections.

However, due to the nature of vintage and second-hand items, we cannot guarantee that they are in perfect condition. By purchasing a pre-loved artwork, you acknowledge and accept that minor imperfections may be present.

 

4. Accuracy of Descriptions

We strive to be as accurate and transparent as possible when describing:

• The origin and materials of an artwork

• The name of the artist

• The estimated period of production

• The historical and cultural context

While we often consult museums, experts, and academic sources, we cannot guarantee that all information is completely error-free or definitive, especially when dealing with vintage or undocumented works.

If you believe that an artwork has been materially misrepresented, please contact us as soon as possible. Any return, refund or other remedy will be handled in accordance with our Return & Refund Policy and your applicable statutory rights.

 

5. Delivery of Featured Artists' Work

• Artworks by our Featured Artists may be held by the artists themselves or by Colours Across.

• Depending on the artwork and the artist's location, the work may be delivered to Colours Across before dispatch or shipped directly from the artist to the customer.

• Colours Across coordinates the sale and delivery arrangements and will provide the customer with relevant information regarding estimated dispatch and delivery times.

• UK delivery is free unless otherwise stated. International delivery may be available by arrangement and will be quoted separately before purchase.

• Full payment must be received before an artwork is released or dispatched.

• We aim to dispatch artworks as promptly as reasonably possible. Where a Featured Artist artwork requires a longer fulfilment period, we will provide or agree an estimated delivery timeframe with you.

 

6. Order Acceptance & Availability

• Order acceptance occurs when we process payment.

• We may cancel an order where reasonably necessary, for example if an artwork is no longer available, there has been a pricing or listing error, payment cannot be authorised, or we reasonably suspect fraud or misuse.

• In case of cancellation, you’ll be notified and refunded.

 

7. Pricing and Payment

• All prices are in Pound Sterling (£). As we are not VAT-registered, no VAT is added to our prices.

• We reserve the right to adjust prices or availability at any time.

• Payment is accepted via the secure payment methods listed at checkout.

• Full payment must be received before an item is dispatched.

• Prices shown for artworks include free UK delivery unless otherwise stated. International delivery costs, where applicable, are quoted separately and agreed before purchase.

 

8. Ownership and Copyright

• Purchasing an artwork gives you ownership of the physical piece only. It does not transfer any intellectual property rights (such as copyright), unless this is explicitly stated in writing.

• Colours Across does not hold copyright for most artworks sold and therefore cannot grant permission for reproduction, publication, or commercial use.

• You may not reproduce, distribute, or commercially exploit any image of the artwork without written permission from the copyright holder (usually the artist or their estate).

 

9. Returns and Refunds

• Please refer to our Return & Refund Policy for full information about cancellations, returns, damaged items and refunds.

• For eligible online purchases, customers have the right to cancel their order within 14 days of receiving the artwork, in accordance with applicable consumer law. After notifying us of the cancellation, the artwork must be returned within the applicable return period and in accordance with our Return & Refund Policy.

• This cancellation right does not affect your statutory rights where an artwork is faulty, damaged or materially not as described.

 

10. Limitation of Liability

While we make every effort to ensure a smooth transaction, we are not liable for:

• Delays caused by circumstances outside our reasonable control, although we will make reasonable efforts to assist with and resolve delivery issues.

• Inaccuracies in third-party historical records or artist biographies.

• Minor discrepancies in colour, tone, or texture due to screen differences.

• Indirect or consequential losses (e.g. loss of earnings or missed exhibitions due to delayed delivery).

 

11. Intellectual Property

• All website content (text, images, design) is owned by Colours Across Art Gallery or its licensors.

• You may not use it without our express written permission.

 

12. Amendments

We reserve the right to update these Terms and Conditions at any time. The latest version will always be published on this page. The Terms applicable to a purchase will be those made available to you at the time your order is placed.

 

13. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales, and any disputes will be resolved in the courts of England and Wales.
